Boating without a licence: what you can take out and what changes in 2026

Motorboats up to 5 metres and 15 hp, sail up to 6, in daylight and within 2 miles. And from 1 October 2026, renting a boat requires a licence.

The million-dollar question: can I really not take out a little boat without a boating licence? 🤔 The answer is that you can, but within very strict limits! We explain where the red line is and why, at our school, we encourage you to go for at least the Navigation Licence. ⚓

The exemption (no licence)

Royal Decree 875/2014 (art. 10) allows boating without a licence in three cases:

  • Motorboats up to 5 metres long and 15 hp (with no power-limiting device), for private use.
  • Sailing boats up to 6 metres, for sporting use.
  • Floating devices or beach craft.

In every case: no more than 2 miles from the port, marina or beach you left from, only in daylight and aged 18 or over. Jet skis are excluded from the exemption.

New: renting without a licence is no longer allowed (1 October 2026)

Royal Decree 1188/2025 (Official State Gazette of 30 December 2025) limits the exemption to private and sporting use. From 1 October 2026, anyone renting one of these boats must hold the corresponding licence: the simplest is the Navigation Licence.

The risk of a fine

Skippering without the required licence is a serious offence under the Ports Act (article 307.2.h), with a fine of up to €180,000, plus the detention of the boat. I explain it in detail in boating fines.
